These Terms & Conditions govern your access to and use of the Rūbas marketplace, where pre-owned and new designer fashion is sold through online auctions. By creating an account, placing a bid, listing an item, or otherwise using the platform, you agree to be bound by these terms.

Scope of these terms

These terms apply to everyone who uses the platform, whether as a buyer, a bidder, or a seller. Specific listings, auctions, and seller offers may carry additional conditions, which you accept when you participate in them.

Rūbas provides the technical platform that brings buyers and sellers together. Unless we expressly state that we are selling an item ourselves, the contract of sale is concluded directly between the winning bidder and the seller of the item.

Your account

To bid or sell you must register an account. You are responsible for everything that happens under your account.

  • You must provide accurate, current, and complete registration information and keep it up to date.
  • You must keep your login credentials confidential and notify us immediately of any unauthorised use.
  • You must be at least 18 years old and able to enter into a legally binding contract.
  • We may suspend or close accounts that breach these terms, provide false information, or engage in fraudulent or abusive behaviour.

Bidding

Every bid you place is a binding offer to buy the item at the bid amount. Bids cannot normally be retracted, and if you are the highest bidder when the auction closes, you are obliged to complete the purchase.

  • Placing a bid constitutes a legally binding offer; winning an auction creates a contract of sale with the seller.
  • Bids must meet the minimum increment shown for each auction and exceed the current highest bid.
  • Some auctions carry a reserve price; if the reserve is not met, the seller is not obliged to sell.
  • Bids may only be withdrawn in exceptional circumstances permitted by law, for example an obvious data-entry error promptly notified to us.
  • You are responsible for all bids placed from your account, including via automated proxy bidding.

Anti-snipe extension

To ensure fair competition, an auction that receives a bid in its final moments will be automatically extended by a short period. This anti-snipe rule repeats for as long as bids keep arriving, so every bidder has a genuine chance to respond before the auction closes.

Buyer premium & fees

In addition to the winning bid (the hammer price), buyers pay a buyer premium and any applicable taxes and shipping. The full breakdown is shown before you confirm your purchase.

  • A buyer premium is charged as a percentage of the hammer price; the applicable rate is displayed on each auction.
  • Any applicable VAT or other taxes are added in accordance with the law and shown at checkout.
  • Shipping, insurance, and handling charges depend on the item and delivery destination.
  • The total payable is the hammer price plus the buyer premium, taxes, and delivery charges, as itemised at checkout.

Payment & delivery

Once you win an auction, you must pay the total amount due using one of the accepted payment methods.

  • Payment must be completed within the period stated at checkout after the auction closes.
  • If you fail to pay on time, we may cancel the sale, charge reasonable costs, and restrict your account.
  • Items are dispatched after payment clears; estimated delivery times are shown per listing and are not guaranteed.
  • Risk of loss or damage passes to you on delivery, except where mandatory consumer law provides otherwise.

Right of withdrawal (EU consumers)

Important: where the seller acts as a trader, EU consumers have a 14-day right of withdrawal. Online auctions are NOT exempt from the Consumer Rights Directive — the public-auction exemption applies only to traditional auctions you can attend in person, not to bidding over the internet.

If you buy as a consumer from a seller acting in the course of a business (a trader), you generally have the right to withdraw from the contract within 14 days without giving any reason.

The Consumer Rights Directive exempts contracts concluded at a "public auction" only where consumers can attend in person. Because Rūbas auctions take place online, this exemption does not apply, and the standard 14-day cooling-off period applies to trader sales.

To make withdrawal easy, the platform provides the mandatory electronic withdrawal button. Where available, you can exercise your right with a single confirmation, and we will send you an acknowledgement of receipt on a durable medium.

  • The 14-day period starts on the day you (or a carrier you nominate) take physical possession of the item.
  • You may withdraw using the electronic withdrawal button, the model withdrawal form, or any other clear statement of your decision.
  • We will refund all payments received, including standard delivery costs, within 14 days of being informed of your withdrawal, using the same payment method.
  • Unless the trader has agreed to bear them, you may have to pay the direct cost of returning the item.

Sales between private individuals (consumer-to-consumer) do not carry a statutory right of withdrawal. Purchases from a private seller are final once the contract is concluded, subject to the authenticity and dispute provisions below.

Prohibited & counterfeit items

Sellers may only list items they are legally entitled to sell. The following are strictly prohibited:

  • Counterfeit, replica, or otherwise non-genuine goods, or items bearing unauthorised trademarks.
  • Stolen goods or items obtained or held unlawfully.
  • Items whose sale is restricted or banned, including protected materials such as certain furs, exotic skins, or ivory.
  • Items that are materially misrepresented as to brand, condition, authenticity, or provenance.

Listings that breach these rules will be removed, and offending accounts may be suspended or closed. We cooperate with rights holders and authorities in cases of suspected counterfeiting or fraud.

Authenticity

Sellers warrant that every item is authentic and accurately described. Where stated, items may be subject to authentication checks, but a listing is not a guarantee against every defect, and condition is sold as described.

If you reasonably believe an item you received is not authentic or differs materially from its description, contact us promptly with evidence. We will review the matter and may facilitate a return, refund, or other resolution in line with these terms and applicable law.

Liability

To the fullest extent permitted by law, Rūbas is not liable for the acts or omissions of buyers or sellers, for the condition or authenticity of items sold by third parties, or for indirect or consequential loss arising from your use of the platform.

Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including your mandatory statutory rights as a consumer.

Governing law & disputes

These terms are governed by the laws of the Republic of Lithuania, and disputes are subject to the jurisdiction of the competent Lithuanian courts, without prejudice to any mandatory consumer-protection rules of your country of residence.

Consumers in the EU may also use the European Commission's Online Dispute Resolution platform to seek an out-of-court settlement.

Changes to these terms

We may update these terms from time to time. We will publish the updated version with a new effective date, and material changes will take effect for future transactions once posted. Continued use of the platform after changes constitutes acceptance.
